Property Fraud FIR or Civil Suit in Punjab: Which Remedy Fits?
Property disputes often involve both civil and criminal allegations. The correct remedy depends on whether the dispute is about title, possession, partition, forged documents, cheating, breach of agreement or illegal occupation.
When a Civil Suit May Be Needed
Civil suits are usually relevant for injunction, possession, partition, declaration, cancellation of sale deed, specific performance or recovery of money. The court examines title papers, possession, revenue entries, sale agreements and limitation.
When an FIR May Be Relevant
Criminal action may be considered where there is forgery, impersonation, use of fake documents, cheating from the beginning, fraudulent power of attorney, fabricated agreement or dishonest inducement.

- Sale deed, agreement to sell, GPA/SPA, registry and payment proof.
- Jamabandi, mutation, intkal and revenue entries.
- Possession proof, photographs, electricity bills or rent documents.
- Police complaint, FIR, legal notice or previous civil-case record.
